2. DESCRIPTION OF SERVICE
The Service is an online property investment analysis/ Simulation tool. Unless explicitly stated otherwise, any new features added to the Service shall be subject to the TOS. You understand that the software is provided "AS-IS".
3. USER ACCOUNT, PASSWORD AND SECURITY
You are responsible for maintaining the confidentiality of your password and subsequent actions under your account.
4. FACTUAL INFORMATION ONLY
You understand that the Service presents factual information ("Content") based on data provided by you and is not intended to imply any recommendation or opinion about a financial product. Please seek independent advice in light of your particular financial circumstances before making any investment decisions. In line with ASIC Regulatory Guide 36 Licensing: Financial Product and Advice and Dealing states. The owners of www.propertyinvestmentportfoliosoftware.com.au and users of our product of our paid version of the product may not hold an Australian Financial Services Licence.

6. INDEMNITY
You agree to indemnify and hold PIPS and employees harmless from any claim or demand, including legal fees, made by any third party arising out of use of Content delivered by the software.
7. ACCURACY
While every effort is made to ensure accuracy of calculations, you agree that PIPS does not guarantee the accuracy of Content transmitted by the Service.
8. MODIFICATIONS TO SERVICE
PIPS reserves the right at any time from time to time to modify or discontinue, temporarily or permanently, the Service with or without notice. You agree that PIPS shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.
9. TERMINATION
You agree that PIPS may, under certain circumstances and without notice, terminate your user account. Cause for such termination shall include (a) breaches of this TOS, (b) requests by you and/or (c) requests by law enforcement bodies.
10. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT a.YOUR USE OF THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. b. PIPS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, (iii) RESULTS PROVIDED BY THE SERVICE WILL BE ACCURATE, (iv) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
11. LIMITATIONS OF LIABILITY
YOU UNDERSTAND AND AGREE THAT PIPS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM (i) THE USE OR INABILITY TO USE THE SERVICE, (ii) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA OR (iii) ANY OTHER MATERIAL RELATING TO THE SERVICE.
12. EXCLUSIONS AND LIMITATIONS
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 9 AND 10 MAY NOT APPLY TO YOU.
13. APPLICABLE LAW
The TOS and relationship between you and PIPS shall be governed by the laws of the State of Queensland, Australia without regard to its conflict of law provisions.
